Recent Aquittal

I recently successfully defended someone accused of filing a false insurance claim, filing a false police report and larceny over $250.  The Defendant parked his car one night only to  find it missing the following day.  He reported it stolen to the insurance company and to the police department.  He was paid off by the insurance company (this was the alleged larceny over $250).  Several months later, the car was found near where it was originally parked with no signs of forced entry.  The Commonwealth alleged that the defendant falsely reported his car stolen to the police and to the insurance company, knowing it was not, and subsequently collected the money from the insurance company.

After a two day jury trial, the defendany was found not guilty on all counts.  The jury agreed with our theory of defense- that the defendant had nothing to do with the theft of his motor vehicle.  Not only was the defendant totally exhonerated, but  he was not responsible for having to pay thousands of dollars in restitution to the insurance company.
